I, the undersigned, hereby make application for an
Exhibitor Booth at the Round Valley Blackberry Festival (RVBF) to be held on August
16th and 17th 2008.
1. This
application is for rental of one booth in a location to be specified by the
Exhibitor Chairperson of the RVBF Committee.
2. Rental
on booths shall be $50.00 craft and $70.00 food, plus $7.50 additional for
electrical service, if needed, for the 2 day festival period. For all
applications postmarked by
August 1, 2008, a $10.00 discount may be taken from the above fees making it
$40.00 for a craft booth & $60.00 for a food booth. Said rental fee must be received with this signed
Exhibitor Application and Agreement. All applications must be mailed to the
above address. Once accepted by the RVBF Exhibitor Chairperson said
RENTAL FEE WILL NOT BE REFUNDED.
3. Each
booth will be substantially the same. Booth hours of operation shall be from
10:00 AM to 5:00 PM on both Saturday and Sunday. All booths must be cleared of
all ExhibitorÕs items, wares, and other personal property and all trash and
other debris removed from the grounds
no later than 6:00 PM Sunday, August 17, 2008.
4. Water
is available on site, but not available at the booths. If you have special
electrical needs, please contact the RVBF Exhibitor Chairperson to verify if
such service is available.
5. There
will be no alterations, modifications, or structural changes made to any booth
by Exhibitor without specific prior approval, in writing, from the RVBF
Committee. Exhibitor shall be liable for any and all damages to the booth
assigned to the Exhibitor.
6. The
number of exhibitor booths is limited. Selection of participating Exhibitors
shall be at the sole discretion of the RVBF Committee. All Exhibitor
Application and Agreement forms, in order to be considered, must be received by
the RVBF Committee not later than August 1, 2008. Please note late fee
information in paragraph 2 of this agreement. In addition, acceptance by the RVBF Committee may be conditional, in
that the RVBF Committee reserves the right to prohibit the exhibition or sale
of any items or wares, which in the sole opinion of the RVBF Committee, are not
in keeping with the ŌFAMILY THEMEĶ
of the festival. Please note: no weapons of any kind (real or toy)
are allowed on the festival grounds.
7. All
Exhibitors shall be responsible for maintaining their booths and the
surrounding area in a safe, neat, and clean condition. All booths and the area
immediately surrounding, will be kept clean and free of trash, liter and other
debris by Exhibitor throughout the duration of the Festival and upon
ExhibitorÕs departure at the close of the Festival. Trash receptacles shall be
provided by Exhibitor for their booth(s) and shall be readily available to and
for the use of the public.
8. There
shall be no alcoholic beverages served, sold, and/or consumed at, or in the
immediate vicinity of any ExhibitorÕs booth. All alcoholic beverages consumed
must be purchased at the Blackberry Festival.
9. All
exhibitors must comply with the instructions or directions of the RVBF
Committee Exhibitor Chairperson, or designated representative, throughout the
entire Festival period; including the periods of initial set-up and departure.
Failure to comply with all instructions and directions associated with the
operation of Exhibitor booths, or Festival events and activities, shall
constitute a breach of this agreement and shall immediately terminate rental.
10. Exhibitors are
solely responsible for their exhibit, property and/ or wares and hereby agree
to hold the RVBF Committee, its parent organization, and all persons associated
therewith, free and harmless from any and all loss, claims, or damages arising
from, or in any manner associated with, their exhibit, personal property, and/or
wares. The RVBF Committee, its parent organization and all persons associated
therewith, disclaim and accepts no responsibility or liability for any
Exhibitor or any activity or event connected with the RVBF, Exhibitors hereby
agree to indemnify and hold harmless, the RVBF Committee, its parent
organization, and all persons associated therewith, for any expense, including,
but not limited to, attorneyÕs fees, arising from such loss, claim or damage.
11. This application
contains the entire agreement between the parties hereto, and may be modified
only by a written statement signed by the RVBF Committee and the Exhibitor.
12. Should any
provision of this agreement be deemed invalid or unenforceable by a court of
competent jurisdiction, all other provisions of the agreement shall remain in
full force and effect.
13. In the event legal
action should be necessary, arising from, or to enforce any term of this
agreement or modification thereof, the prevailing party shall, in addition to
such other relief as may be proper, be entitled to all costs of suit, to
include attorneyÕs fees.
Mendocino
County Health Ordinance prohibits any animals on the premises.
I HAVE READ, UNDERSTOOD, AND AGREE TO ALL OF THE
ABOVE TERMS AND CONDITIONS.
